TORROT RENT - Terms and Conditions

1. Return of the MOTORCYCLE:

The CLIENT agrees to return the MOTORCYCLE to the designated THE DISTRIBUTOR facility between * and * on the day the contract expires, in the same condition in which it was delivered, except for normal wear and tear resulting from proper use.

2. Services Excluded from Rent:

The rental fee does not include:

1. Extraordinary maintenance or repairs due to improper use, negligence, or accidents;
2. Replacement of damaged or missing parts;
3. Transportation or delivery costs of the vehicle;
4. Safety equipment (gloves, protective gear, technical clothing, helmet, etc.);

3. Mechanical Breakdowns:

If the MOTORCYCLE cannot complete the rental term due to mechanical issues, the CLIENT acknowledges that the breakdown is beyond THE DISTRIBUTOR's control. THE DISTRIBUTOR will only be responsible for reimbursing the unused rental period.

4. CLIENT Responsibility:

The CLIENT is solely responsible for the use, maintenance, and operation of the MOTORCYCLE, regardless of the user’s age. The CLIENT will be liable for any damages caused to or by the MOTORCYCLE, regardless of who was operating it at the time of the incident.

5. Usage Restrictions:

The CLIENT shall not:

1. Participate in or allow participation in any sports competitions, races, official or unofficial training, or endurance tests;
2. Make or allow any modifications, repairs, or part replacements;
3. Transport or allow the transport of flammable, dangerous, radioactive, toxic, or harmful goods, or goods exceeding the authorized weight, quantity, or volume;
4. Remove or add stickers on any part of the MOTORCYCLE. A penalty of **€ will be charged for each sticker removed or added;
5. Comply with all traffic and vehicle usage regulations.

6. Accidents:

The CLIENT must immediately notify THE DISTRIBUTOR of any accident and forward any related letters, summons, or notifications without delay, cooperating fully with the insurance company in investigating and defending any claim or legal process.

7. Fines and Penalties:

Until the MOTORCYCLE is returned, the CLIENT is solely responsible for any fines, penalties, accidents, damages, legal fees, and other expenses incurred by THE DISTRIBUTOR due to traffic violations or improper vehicle usage.

8. Insurance:

THE DISTRIBUTOR provides the MOTORCYCLE with third-party liability insurance (mandatory and voluntary civil liability, legal defense, and roadside assistance).

9. Keys and Lock:

In case of loss, theft, damage, or deterioration of the keys or lock, the CLIENT will pay the replacement cost plus an additional 50% as compensation.

10. Security Deposit:

The CLIENT provides a security deposit of **€. THE DISTRIBUTOR may apply this deposit to cover any amounts payable by the CLIENT under this contract or by law. This deposit is additional and does not replace the CLIENT’s personal, direct, and unlimited liability towards THE DISTRIBUTOR.

11. PURCHASE OPTION:

At any time before the expiration of the rental period, the CLIENT may choose to purchase the MOTORCYCLE at the price specified above by clearly expressing their intention. Any rental payments made and the security deposit will be deducted from the purchase price. If the purchase option is exercised, the MOTORCYCLE will be received by the CLIENT in its current condition, with no claims against THE DISTRIBUTOR. The CLIENT will bear all costs related to the transfer of ownership of the MOTORCYCLE.

** Torrot only recommend a rental fees. Each distributor can apply some increase or discount according their own strategy. Even the security deposit can change by each distributor.
